Common questions

Is this a drafting copilot?

No. A copilot helps you write. Patly Examiner takes what you wrote and examines it the way the Office will, then hands you the rejections with the responses drafted. Keep whatever you draft with and run Patly Examiner on the output.

What do I upload?

For Patly Examiner, the claims and specification as DOCX or PDF, and the figures if you have them. For Respond, the office action and the application as filed. For the package, a disclosure: a write‑up, a paper, a deck, or notes from the inventor.

How do I know the simulated examination is right?

Run it on the last ten applications you filed and compare the report with the office actions you received. We will do that comparison with you. The examination hunts for the strongest rejection available rather than confirming the draft is fine, so it will sometimes raise a rejection the examiner does not; the ones it raises are the ones worth answering before filing.

Where do my client's files go?

Uploads stay in your account for the matter, are never used to train a model, and are deleted when you ask. Prior art maps stay until you delete them. A data processing agreement and an NDA are available on request.

What does the USPTO say about using this?

The Office's April 2024 guidance on AI tools is the standard: the practitioner signs under 37 CFR 11.18, must make a reasonable inquiry, and cannot delegate the signature; using a tool is not by itself something that has to be disclosed. Patly Examiner exists to make that inquiry faster and more complete, not to replace it. Confidentiality under 37 CFR 11.106 is why uploads are never used to train a model and are deleted when you ask.

Don't you compete with my firm for university work?

Can I bill this to the client?

Every order has a flat published price, so it can be passed through as a disbursement or absorbed into a flat fee. The Patly Examiner report attaches to the matter as the record of what was checked before filing.

Patly Examiner is $349 per application, $299 each in blocks of 10 or more and $249 in blocks of 50 or more. Respond is $299 per office action. The non‑provisional package is $5,500 and the provisional package $995, the same rates a university pays, because it is the same application. What differs is who signs and files it: a university has no practitioner of its own, so licensed counsel reviews and signs before we file, and a firm signs under its own name.
