Personalized art unit and examiner prediction

Know where your application will land, and who will examine it, before you file

The office routes every new application to an art unit by its classification, then to an examiner by docket, backlog and portfolio. This report does the same arithmetic from your claims: the art unit it will be routed to, then the ten examiners most likely to receive it, ranked by probability, with the reason for each, and the report’s own measured accuracy on recent filings.

Art unit and examiner prediction: the report, from the verdict and the classification picture to the ten examiners ranked
What the report says

Three things no filing should go without

The unit

Where it will be routed

The art unit, with the probability of each candidate unit, drawn from where the application’s classification picture has been routing in the last three years. For a continuation, the parent’s unit and examiner are applied the way the office applies them.

The examiners

Who is likely to receive it

Every active examiner in the candidate units, scored on intake share, symbol share, portfolio fit, qualification, recency and your applicant’s history, and the ten most likely, ranked, each with the reasons. Each one links to the examiner’s page in Patent analytics: grant rate, difficulty, what works.

The steering

What would move it

The classification picture the routing rests on, drafted from the claims and checked against the nearest recent filings, and which claim changes would steer the application toward a different unit, with that unit’s grant rate beside it.

How it works

The office’s own routing, run on your claims

The picture

The claims are classified the way the office classifies them, and the picture is checked against the nearest recent filings in the record.

The unit

Where that picture has been routing, measured on every application of the last three years, gives the candidate units and their odds.

The examiners

Every active examiner in those units is scored on the factors the office weighs, then each candidate’s recent docket is read and the score adjusted by a stated, bounded amount.

The calibration

The same method is run on held-out recent filings, so the report states its own top-1 and top-5 accuracy for units and examiners.

Questions

The fine print, in plain words

How accurate is it?

Each report carries its own calibration: the method is run on recent filings held out of the record, and the report states the share of them whose unit was the top prediction, and whose examiner was in the top one, five and ten. Routing to a unit is reliable; the examiner within a unit depends on docket and backlog the office does not publish in advance, so the ranking is probabilities, not a name.

What do I need to send?

The claims, pasted or in the attached draft. The applicant helps, because the office weighs an applicant’s history with an examiner. A parent application number matters most of all: a continuation usually goes to the parent’s examiner.

Can it tell me how to steer the application?

Yes. The report shows which claim framings move the picture into another unit, with that unit’s grant rate beside it. Whether to do so is a drafting decision; the report gives the arithmetic.

Is this the same as the examiner statistics?

No. Patent analytics tells you about an examiner once you know who it is. This report tells you who it is likely to be, before you file, and links each candidate to their analytics page.
