At a company

Nothing is published until counsel has read it. Patent attorneys screen every paper before it goes out, the application is filed first, and inventors are paid and promoted for it.

At a university

Publish first, nobody screens. Disclosure is voluntary, a patent earns no tenure credit and no bonus, and most faculty never learn that a paper can be one. The paper starts a 12-month clock and the rights lapse.
